Insurance fraud is a very serious problem, estimated to cost the insurance industry and honest policyholders $50 billion every year.

We have litigated cases in state and federal courts throughout the United States. We know how to devise strategies for successful resolutions to insurance fraud and reverse bad faith matters, including conducting examinations under oath at the scene of a loss, thus preserving evidence that may later prove useful in the handling of the claim. We understand the importance of interviewing the insured's public adjusters and accountants, as well as arranging for forensic experts to actually participate in the questioning of insureds or the insureds' experts on technical issues in order to form the basis of expert opinions.

Members of our team also serve on the Board of Directors of the International Association of Special Investigation Units ("IASIU") and have worked closely with Pennsylvania's Insurance Fraud Prevention Authority (IFPA) and the Pennsylvania Auto Crime Investigators Association (PACIA).

Our lawyers have served the insurance industry in a variety of capacities for more than 30 years, working where the fight against insurance fraud has mattered most. We have worked with federal and state prosecutors, representatives of the Bureau of Alcohol Tobacco Firearms and Explosives (ATF), and the FBI, as well as state and local fire marshals. Global Warming Lawsuit Raises a Host of Coverage/Liability Concerns.  In a decision could open the door for waves of suits against pollution emitting entities, the United States Court of Appeals for the Second Circuit allowed two related lawsuits to proceed that attempt to use the court system to halt the effects of global warming. In State of Connecticut, et al. v. American Electric Power Co., et al. , ___ F.3d ___, 2009 WL 2996729 (2d. Cir. Sept. 21, 2009), the Second Circuit reversed an order of the United States District Court for the Southern District of New York granting a motion to dismiss the plaintiffs' complaint against six utility defendants. The plaintiffs (eight different states, the city of New York and three land trusts) seek a judgment ordering carbon dioxide emitting utility companies to reduce emissions. The Second Circuit's holding raises not only numerous complex defense issues, but also concerns in the area of insurance coverage. ...
