In August of 2000, Mike Nelson, Ken Levine, Dan de Luca and Bob Horst opened the doors of NLdH. From the start, we worked hard to prove ourselves to our clients, quickly gaining their allegiance. We were entrusted with significant national litigation, litigation that we resolved successfully. Our success in these cases, cases that are historic in the insurance industry, quickly built our reputation as insurance law attorneys.

This attention led to immediate and dramatic expansion. Before the close of our third year, NLdH was listed in Pennsylvania Law Weekly's 100 largest firms in Pennsylvania. To our first location in the Philadelphia area, we have added offices in Cherry Hill, Newark, Columbus, New York and London. We have earned our reputation as a one-of-a-kind law firm equipped to handle the most complex legal matters that arise for clients within the insurance industry.

Our History Within the Insurance Industry

What would lead an insurance company to enlist us to handle such significant cases? While we are a young law firm, our history within the insurance industry stretches back more than 30 years. Prior to becoming attorneys, members of our team have held positions ranging from claims officials to legal officials at insurance companies and in the insurance regulatory community.

Our knowledge, understanding and background in the insurance industry are reasons our clients frequently cite when asked why they turned to us. They know that we have practical experience in the business, and knowledge beyond that necessary for lawyers. It is that hands-on experience that sets us apart from other law firms that handle these matters.

This is why we have been able to garner the confidence of some of the largest insurers in the world to manage their complex issues and regulatory compliance matters throughout the United States. In fact, we currently have cases active nationwide.

Our Role in the Future of Insurance Law

We have cemented our position as authorities on complex insurance issues not only by succeeding in the most challenging cases, but by remaining active beyond the courtroom. We act as national coordinating counsel for several insurers on wide-ranging issues of importance. We regularly testify in Washington and before the National Association of Insurance Commissioners. We represent insurance departments as clients. Our lawyers are known nationally as authorities on regulatory matters, reinsurance, insurance class action extra contractual liability and subrogation. We are also on the forefront of reform efforts on e-discovery, class action and the attorney client privilege.

We publish periodicals, including a weekly ad hoc e-bulletin addressing "breaking news" on significant issues for insurers, a monthly periodical, "Up To Speed," focusing on national insurance litigation and regulatory issues affecting automobile insurers, and a quarterly periodical focused on regulatory issues "The Regulatory Current" that is released in sync with the National Association of Insurance Commissioner's quarterly meetings. All of our partners have published articles pertaining to issues affecting insurers. Currently, we are publishing a book through American Lawyer Media on the topic of extra-contractual litigation from a national perspective.

As the insurance industry faces a changing legal and regulatory landscape, our knowledge of the industry is a valuable asset to decision-makers concerned with effective and rapid resolution of legal challenges.

Global Warming Lawsuit Raises a Host of Coverage/Liability Concerns.  In a decision could open the door for waves of suits against pollution emitting entities, the United States Court of Appeals for the Second Circuit allowed two related lawsuits to proceed that attempt to use the court system to halt the effects of global warming. In State of Connecticut, et al. v. American Electric Power Co., et al. , ___ F.3d ___, 2009 WL 2996729 (2d. Cir. Sept. 21, 2009), the Second Circuit reversed an order of the United States District Court for the Southern District of New York granting a motion to dismiss the plaintiffs' complaint against six utility defendants. The plaintiffs (eight different states, the city of New York and three land trusts) seek a judgment ordering carbon dioxide emitting utility companies to reduce emissions. The Second Circuit's holding raises not only numerous complex defense issues, but also concerns in the area of insurance coverage. ...
