Mark C. Stephenson focuses his practice on the representation of business entities and entrepreneurs. He represents corporations, directors, and officers with regard to D&O claims, and also ERISA and non-ERISA benefit plan sponsors, claim fiduciaries, insurers, and third-party administrators in consultation and in litigation regarding life, accident, health, disability, and other benefits.

Mr. Stephenson represents self-funded plans in connection with excess risk and stop-loss arrangements, and parties engaged in the reinsurance of life, accident, health and disability benefits. Additionally, he represents plan sponsors and insurers with reference to the recovery of overpaid and subrogated benefit payments.

Mr. Stephenson also represents employers concerning claims of employment discrimination, breach of contract, enforcement of restrictive covenants, and related matters. In addition, he advises and defends employers regarding employer liability for MPPAA withdrawal liability and defense of demands for payment.

Mr. Stephenson is frequently invited to present lectures to clients and industry trade groups and has spoken at the Eastern Claims Conference for a number of years on a variety of topics related to life, accident, health and disability issues. He will be presenting a discussion of forensic issues in life, accident, and disability claims at the ECC 2007 Conference. Recently, Mr. Stephenson was a speaker at the Annual Meeting of the Federation of Defense and Corporate Counsel with regard to defense of disability insurance claims based on subjective complaints of pain. He also was a featured speaker at the October 2007 annual conference of the International Disability Income Society, where he discussed ERISA and its impact on disability insurance.
